SECTION 5 - STORAGE PERIODS, WAREHOUSING AND HOLDING CHARGES

Applicability: Rates and charges applicable to storage, handling, or holding services rendered by Rexco-US LLC apply to custom orders, hold-for-pickup inventory, wholesale shipments, and equipment left for technical repair beyond the standard pickup window. Rexco-US LLC reserves the right to adjust storage rates after 5 days' written notice to the Customer.
Handling Fees: Where a receipt or service ticket covers multiple items or bulk lots, a minimum handling charge of 1.5% of the total amount per brand or variety may apply.
Holding Charges & Payment Terms: Warehousing and holding charges apply from the date Rexco-US LLC accepts care, custody, and control of the goods or completes technical service work. Customer shall pay all outstanding storage, repair, and product balances prior to the release of inventory from the warehouse or retail store.
Taxes & Interest: Customer is responsible for any local, state, or federal taxes imposed in connection with their stored goods. Rexco-US LLC shall be entitled to charge interest at the rate of 1.5% per month (or the maximum allowed under Florida law) on any unpaid balance. Rexco-US LLC retains all lawful possessory and warehouseman liens provided under applicable state law until all outstanding balances are paid in full.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email, billing address, or phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

SECTION 7 - OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or direct you to third-party links (such as payment gateways, diagnostic software, or manufacturer warranty portals). We provide access to such tools and links "as is" and "as available" without any warranties, endorsements, or conditions of any kind. IN NO CASE SHALL REXCO-US LLC, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND—INCLUDING LOST PROFITS, LOST REVENUE, REPLACEMENT COSTS, OR PROPERTY DAMAGE—ARISING FROM YOUR USE OF ANY OF THE SERVICES OR PRODUCTS PROCURED USING THE SERVICE.

OPERATIONAL RISK ACKNOWLEDGMENT: Remote-controlled products (including RC vehicles, aircraft, boats, drones, and Lithium Polymer batteries) involve inherent operational risks. Users assume full personal responsibility for safe operating procedures, battery maintenance, local safety compliance, and property safety.

SECTION 12 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Rexco-US LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, suppliers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

SECTION 13 - MANDATORY MEDIATION AND DISPUTE RESOLUTION

13.1 Pre-Litigation Mediation Requirement. By placing an order, requesting technical services, or purchasing products or services from Rexco-US LLC through this website, by purchase order, or through any other sales channel, you explicitly agree that any dispute, controversy, or claim arising out of or relating to any transaction, contract, performance, or breach thereunder shall first be submitted to mandatory, confidential, and impartial mediation prior to initiating any litigation, court action, or formal administrative proceeding.

13.2 Mediation Procedure. Mediation shall be conducted in the State of Florida by a single mediator certified by the Supreme Court of Florida, mutually agreed upon by the parties. If the parties cannot reach an agreement on the selection of a mediator within fifteen (15) calendar days following receipt of a written demand for mediation, either party may request the appointment of a qualified mediator through the American Arbitration Association (AAA) or a court of competent jurisdiction in Florida.

13.3 Timeline and Costs. If the dispute is not fully resolved through mediation within sixty (60) calendar days after service of the initial written demand for mediation, either party may pursue any available legal or equitable remedies in the designated court venue. Unless otherwise mandated by non-waivable statutory rights under applicable Florida law or agreed upon in writing by both parties, each party shall bear its own attorneys' fees and legal expenses, and shall share equally all direct costs of the mediation process (including mediator fees and facility rentals).

13.4 Class Action and Jury Trial Waiver. To the fullest extent permitted by law, all claims must be mediated and litigated on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. THE PARTIES HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION ARISING OUT OF OR RELATING TO THIS TRANSACTION.

13.5 Governing Law and Venue. This agreement, and all claims or causes of action arising out of or related to transactions with Rexco-US LLC, shall be governed by, enforced, and construed in accordance with the laws of the State of Florida, without giving effect to its conflict of law principles. The exclusive forum and venue for any litigation permitted following the completion of mediation shall be the state or federal courts located in Orange County, Florida [or your local Florida county], and you hereby submit to the personal jurisdiction of such courts.

SECTION 14 - SEVERABILITY & TERMINATION

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed without affecting the validity and enforceability of any remaining provisions.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

SECTION 15 - GOVERNING LAW & VENUE

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Florida, United States. Any legal action or judicial proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Brevard County, Florida.
