Welcome to REXCO-US RC HOBBY SHOP. Throughout the site, price quotes, proposals, invoices, and purchase agreements, the terms “we”, “us”, and “our” refer to Rexco-US LLC (doing business as REXCO-US or REXCO-US RC HOBBY SHOP).

We operate this online store, physical retail locations, and website (www.rexco-us.com), including all related information, content, features, tools, products, price quotes, proposals, and technical repair services to provide you, the customer, with a curated shopping experience (the "Services"). Our online store is powered by Shopify, which enables us to securely process transactions and provide the Services to you.

The terms and conditions below, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you access or use our Services. Please read these Terms of Service carefully before using our website or making a purchase.

By visiting our site, interacting with our Services, requesting a price quote or invoice, or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service, including our Privacy Policy and Refunds & Returns Policy. SECTION 1 - ONLINE STORE & ACCOUNT TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence (18 years of age in Florida), or that you are the age of majority and have given us your consent to allow any of your minor dependents to use the Services on devices you own or manage.

To access certain features, request quotes, or complete purchases, you may be required to provide accurate personal details, such as your email address, billing address, payment details, and shipping information. You represent and warrant that all information provided is true, current, and complete.

You are solely responsible for maintaining the security of your account credentials. You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including intellectual property laws). A breach or violation of any of the Terms will result in an immediate termination of your access to the Services.

SECTION 2 - GENERAL CONDITIONS & PRODUCT DISCLAIMER

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transfer over secure networks.

  • Product Representations: We make every effort to display the colors, features, and specifications of our products accurately (including RC vehicles, electronic speed controllers, radio transmitters, motors, parts, and accessories). However, actual visual representations may vary depending on your screen settings or manufacturer revisions.

  • Modifications & Discontinuance: All descriptions of products and pricing are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product or technical repair service at any time.

SECTION 3 - ORDERS, PRICES & BILLING

  • Order Acceptance: When you place an order, submit a purchase order, or accept an invoice, you are making an offer to purchase. Rexco-US LLC reserves the right to accept or decline your order for any reason at its sole discretion. Your order is not confirmed until payment is processed and written acceptance is issued.

  • Pricing & Taxes: Posted prices do not include taxes, shipping, handling, or customs charges unless expressly stated otherwise. Prices offered online may differ from prices at our physical retail location.

  • Order Limits & Cancellation: We reserve the right to limit or cancel quantities purchased per person, per household, or per order. Cancellations are handled in accordance with our Refunds & Returns Policy.

  • Personal Use Only: You represent and warrant that purchases are for personal, household, or authorized organizational use, and not for unauthorized commercial resale or illegal export.

SECTION 4 - STORAGE PERIODS, WAREHOUSING AND HOLDING CHARGES

  • Applicability: Rates and charges applicable to storage, handling, or inventory holding rendered by Rexco-US LLC apply to custom orders, hold-for-pickup merchandise, wholesale shipments, and equipment left for technical repair beyond the standard pickup window. Rexco-US LLC reserves the right to adjust storage rates after five (5) days' written notice to the Customer.

  • Handling Fees: Where a receipt or repair ticket covers multiple items or bulk lots, a minimum handling charge of 1.5% of the total order value per brand or lot may apply.

  • Holding Charges: Warehousing and holding charges begin accruing from the date Rexco-US LLC accepts care, custody, and control of the goods or completes a technical repair service.

  • Payment & Liens: Customer shall pay all outstanding storage, repair, and handling balances prior to the release of goods. Rexco-US LLC is entitled to charge interest at the rate of 1.5% per month (or the maximum allowed under Florida law) on any unpaid balance. Rexco-US LLC retains all lawful possessory and warehouseman liens under applicable Florida state law until all outstanding balances are settled.

SECTION 5 - SHIPPING, DELIVERY AND RISK OF LOSS

All delivery times and transit estimates are approximate and not guaranteed. Rexco-US LLC is not liable for shipping delays caused by freight carriers, customs procedures, or force majeure events outside our control. Once products are transferred to the carrier, title and risk of loss or damage pass entirely to you.

SECTION 6 - INTELLECTUAL PROPERTY

All content, trademarks, logos, brand assets, product descriptions, images, layout designs, and software contained within the Services are owned by or licensed to Rexco-US LLC or Shopify and are protected under United States and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive license to use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, or exploit any portion of the Services without prior written permission from Rexco-US LLC.

SECTION 7 - OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools, payment gateways, or hyperlinks to external websites (such as manufacturer diagnostic applications or warranty portals). We provide access to such tools and links "as is" and "as available" without any warranties, conditions, or endorsements. We carry no liability whatsoever arising from or relating to your use of third-party tools or external websites.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

Rexco-US LLC is hosted on the Shopify e-commerce platform. While Shopify provides the infrastructure for our online store, any sales, contracts, and purchases you make are directly between you and Rexco-US LLC. You expressly release Shopify Inc. and its affiliates from all claims, losses, or damages arising out of or related to your transactions with Rexco-US LLC.

SECTION 9 - USER COMMENTS, FEEDBACK AND REVIEWS

If you submit product reviews, suggestions, technical ideas, or feedback ("Feedback"), you grant Rexco-US LLC a perpetual, worldwide, royalty-free license to edit, copy, publish, distribute, and use such Feedback in any medium for commercial or promotional purposes. We are under no obligation to keep Feedback confidential or pay compensation for its submission.

SECTION 10 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our website, quotes, or invoices may contain typographical errors, inaccuracies, or omissions regarding product specifications, pricing, promotions, shipping fees, or stock availability. Rexco-US LLC reserves the right to correct any errors and to change, update, or cancel orders if any information is inaccurate at any time without prior notice (including after an order has been submitted).

SECTION 11 - PROHIBITED USES & AGENTS

You are prohibited from using the site or its content:

  1. For any unlawful purpose or to solicit others to perform illegal acts.

  2. To violate local, state, federal, or international laws and regulations.

WE DO NOT GUARANTEE THAT YOUR USE OF OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL REXCO-US LLC, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, OR SHOPIFY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND—INCLUDING LOST PROFITS, LOST REVENUE, REPLACEMENT COSTS, OR INJURY TO PROPERTY ARISING OUT OF YOUR USE OF ANY SERVICE OR PRODUCT PROCURED FROM US.

You agree to indemnify, defend, and hold harmless Rexco-US LLC, Shopify, and our officers, directors, agents, contractors, licensors, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or third-party right.

SECTION 15 - SEVERABILITY & ENTIRE AGREEMENT

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity of any remaining provisions.

These Terms of Service constitute the entire agreement between you and Rexco-US LLC regarding your use of our site and services, superseding any prior written or oral agreements.

SECTION 16 - GOVERNING LAW & VENUE

These Terms of Service and any separate agreements under which we provide you Services shall be governed by and construed in accordance with the laws of the State of Florida, United States. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the state or federal courts located in Brevard County, Florida.
